As an alternative to the general rule that the importer and the first level of distribution chain in Denmark has the producer responsibility producers from an EU country may without establishment in Denmark choose to designate an authorised / appointed representative (AR) in Denmark to assume their producer responsibility for all equipment sold on the Danish market.
Businesses from an EU country without establishment in Denmark and dealing in distance selling of electrical equipment directly to end-users in Denmark must designate an authorised representative (AR) in Denmark to assume their producer responsibility for all equipment sold on the Danish market.
In practice, through the DPA-System producer register the European company designates an authorised representative with a Danish CVR (VAT no.) number to assume the producer responsibility for this company in Denmark. When the AR has confirmed the designation the official registration is made in the producer register.
Companies from outside the EU without establishment in Denmark and dealing in distance selling of electrical equipment directly to end-users in Denmark must register directly in the DPA-System register.
The authorised representative has the legal responsibility towards the authority on behalf of the producer, while a collective scheme is a company offering to producers to carry out a number of practical tasks, including collection and recovery - with the purpose of benefiting from economies of scale.
However, collective schemes may also offer the AR role. A special IT-function has been developed in the register for this purpose.
