Exemptions

Certain types of equipment are subject to an exemption from producer responsibility. On the following pages the ten exemption criteria in Denmark are explained.

It is the responsibility of the producer/the importer to make sure that rules are complied with, and thus the producer himself must make an assessment of his products. In case of doubt it is necessary to make a concrete assessment to decide whether a specific piece of equipment is covered by the rules on producer responsibility. You may contact the Environmental Protection Agency or DPA-System for guidance.

Exemptions from the producer responsibility for electrical equipment are:


1.    Motor-driven vehicles covered by the Road Traffic Act.
2.    Equipment manufactured specifically for military purposes or for protection of national security.
3.    Batteries and accumulators.
4.    Containing sealed radioactive sources.
5.    Using a voltage equal to or greater than 1,000 VAC or 1,500 VDC.
6.    Large-scale stationary industrial tools (under category 6).
7.    Infected medical devices (under category 8).
8.    Smoke detectors containing radioactive substances.
9.    Filament bulbs (under category 5).
10.  Luminaires in households (under category 5).


The illustration shows that basically all electrical and electronic equipment is covered by producer responsibility according to the Order – as shown by the circle. Subsequently ten criteria exempting equipment from the Order have been introduced. These are illustrated by the pie slices below.
